INTRODUCTION

Balloon business falls under recreational service providers under Australian Consumer Law (Victoria) for limited liability. We guarantee that the services supplied to you:

·         are rendered with due care and skill;

·         are reasonably fit for any purpose which you, either expressly or by implication, make known to us.

 

You should be aware that:

1.  Under any circumstances, DO NOT inhale the inflation gas (especially helium),

2.  Do not use the balloons for any purpose other than decoration,

3.  If you intentionally pop a balloon, be aware that this results in sudden pressure release which may cause damage in the surrounding area. You are solely responsible to exert due-diligence when doing so and we take no responsibility what-so-ever of such action

4.  The deliberate releasing of balloons is illegal in Victoria. The Environment Protection Authority now having increased powers to prevent harm to the environment from pollution and waste. We urge everyone NOT to be involved in balloon release and take no responsibility of anyone who used our products in such acts.

 

DIFINTION

Throughout the website, the terms “we”, “us” and “our” refer to Loli’s Art Balloons. “You” refers to website user being a customer, agent or anyone/entity that uses the services provided by us.

By using the services, we provide, you agree that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

 

TERMS OF USE

The content on the Site is subject to copyright, trademarks and other intellectual property rights. These rights are owned by or licensed to Loli’s Art Balloons.

You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted over various networks

Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy the content on the website through which the service is provided, without express written permission by us.

 

MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Service.

QUALITY, ACCURACY, and COMPLETENESS OF INFORMATION

The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information.

The material used in our products may have limited quantities. We reserve the right to provide the purchased products like to and as close as practicable to the placed order.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your monitor's display of any color will be accurate.

We take no responsibility to what may happen to your balloons after we deliver and set them up. Please note that heating and cooling affects the balloons (may cause them to shrink or pop) and we cannot take any responsibility for these things that are out of our control

Pick up is available at pre-agreed time. We take no responsibility to what may happen to the balloons when they leave our hands

Your submission of personal information through the store is governed the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 on how we collect, use, disclose, store, secure and dispose of your Personal Information.

REFUND

Consumers have refund rights under the Australian Consumer Law under certain circumstances. The amount of the refund may depend on the services provided at the time the order was cancelled.

We start preparing your order as soon as payment is received, this includes designing and cutting decal, ordering stock, double stuffing balloons when required, and pre-inflating balloons up to 3 to 5 days before delivery date.

1. Texts are cut as soon as order comes through

2. Foil balloons are pre-inflated in advance to test for faults and re-inflated on the day of delivery

3. Bubble balloons are made the day before to test for faults

4. Balloon garlands are inflated up to 5 working days prior to event date

 

Payment Terms

• Online purchases require full payment at the time of placing your order. Order confirmation and invoice will be automatically sent when payment is received.

• Event booking and setup, we require a 50% deposit at the time of booking of the total invoice amount. Balance is due 5 working days from the event date.

• By providing payment, you agree to our refund policy and the below terms and conditions.

 

Cancellation and Refund

• The refund amount depends on the amount of work done at the date of cancellation, a minimum of 20% is deducted as cancellation admin fees.

• No refund for cancellation made within 5 days of the delivery as by this time your order is mostly ready.

• No Refunds will be given for change of mind.

• No Refund can be claimed once the product is delivered/picked up and is no longer in our custody.

 

Postponing and Store Credit

• Postponing your event date requires a minimum of 5 working days’ notice to receive 100% store credit provided that no work has been done on your order (see above).

• Should we have started working on your order (e.g., text cut or balloons pre-inflated), you will be given partial store credits to cover for labour and material cost.

• We reserve the right to refuse changes made less than 5 working days from the event date. Changes include delivery address, time, colours, balloon varieties, and text with the exception being gift note which we can happily add for you. Having said that, we will try to accommodate your change request as much as possible.

 

Warning

Balloons are a fragile product and can sometimes pop without warning. Heating and cooling affect the balloons (may cause them to shrink or pop) and we cannot take any responsibility for conditions that are out of our control. Please make sure you keep your balloons in a stable environment. No refund can be claimed once the product is delivered and is no longer in our custody.
